NO PURCHASE NECESSARY. VOID WHERE PROHIBITED
PROMOTION DESCRIPTION: The Long Range™ Sweepstakes (the “Sweepstakes”) begins on or about Wednesday, June 15, 2011 at 12:01 a.m. Eastern Time (“ET”) and ends on Thursday, December 1, 2011 at 11:59 p.m. ET (the “Promotion Period”). Rocky's computer shall serve as the official time-keeping device for the Sweepstakes. Entry in the Sweepstakes does not constitute entry into any other promotion, contest, or sweepstakes.
BY ENTERING SWEEPSTAKES, PARTICIPANTS UNCONDITIONALLY AGREE TO ACCEPT AND BE BOUND BY ALL TERMS OF THESE OFFICIAL RULES AND THE FINAL DECISIONS OF THE SPONSOR, Rocky Brands, Inc. (“Rocky” or “Sponsor”) 39 East Canal Street, Nelsonville, OH 45764, which shall be final and binding in all respects.
1. Eligibility: The Sweepstakes is open only to legal residents of the contiguous United States and Washington DC who are at least eighteen (18) years of age at the time of entry and capable of forming legally binding contracts under applicable law. Employees of Sponsor and its affiliates, subsidiaries, distributors, suppliers, promotion and advertising agencies, and the immediate families (parent, child, sibling and spouse of each) and household members of each such employee are not eligible.
2. To Enter: Eligible participants may enter online during the Promotion Period, enter by visiting www.rockyboots.com/longrange and accessing the online Sweepstakes entry form. The online entry instructions will also be available at participating Rocky retailers. Complete the entry form and submit so that it is received by Sponsor's server by 11:59 p.m. ET on December 1, 2011.
Entries are limited to ONE ENTRY PER PERSON.
3. Random Drawing and Odds of Winning: On or about December 2, 2011, the Sponsor will conduct a random drawing from among all eligible entries received to award a Second Prize (first name drawn), a First Prize (second name drawn), and a Grand Prize (final name drawn). The odds of winning are dependent on the number of eligible entries received during the Promotion Period. Sponsor's selection of potential winners is final and binding.
4. Prizes: All stated values of prizes are the Approximate Retail Value (“ARV”) in U.S. Dollars. The ARVs have been estimated as of March 1, 2011. Total ARV of all Prizes is $28,000.
a. Grand Prize: Rocky Edition 2012 Dodge Ram 1500 truck (with some Rocky logos and branding). Grand Prize ARV: $24,000.
b. First Prize: Outdoor expedition and hunt with Hank Parker. First Prize ARV: $3,000.
c. Second Prize: Long Range head-to-toe outfit with footwear. Third Prize ARV: $1,000.
5. Details and Conditions on Prizes: All costs not specifically stated are responsibility of the winners.
a. Grand Prize: Grand Prize Winner will be provided instructions to obtain his/her Grand Prize vehicle at a dealership to be determined by Sponsor. Color, package, factory options, and other prize specifics are to be determined by Sponsor and are subject to availability. Grand Prize Winner must have proof of a valid driver's license from Grand Prize Winner's state or place of residence in the United States to take delivery of vehicle; failure to show same may result in prize forfeiture. Grand Prize Winner will be responsible for all optional equipment, upgrades, title, license, insurance and registration fees required in claiming the vehicle, applicable taxes as well as all other expenses relating to the receipt and use of Sweepstakes Prize vehicle, including any travel and transportation costs associated with collecting the vehicle. As a model year progresses, changes may occur in some of the specifications, features, optional equipment and pricing. Optional equipment may vary by region. Delivery subject to manufacturer, distributor, and dealer manufacturing, production and delivery schedules.
b. First Prize: The Hank Parker Outdoor Expedition will consist of a gun or bow hunt which is to take place sometime during or around the spring of 2012, or at an alternative time per Sponsor's sole discretion. The date, location, and nature (animals hunted, guns, bows, or other used) of the Hank Parker Outdoor Expedition is subject to availability and Sponsor's sole discretion. All or portions of the Hank Parker Outdoor Expedition may or may not appear on the HP3D television show. In any case, WINNER'S APPEARANCE ON THE SHOW IS NOT GUARANTEED, and Sponsor does not guarantee that the Hank Parker Outdoor Expedition prize will in fact take place during the recording of the HP3D television show. Hank Parker Outdoor Expedition winner will receive roundtrip airfare for the hunt and lodging during the hunt (but not before or after) for one person, and a hunting tag. Identification in the form of a valid driver's license or government-issued identification, and proof of a current Hunting Education Certificate (the sufficiency of which will be determined in Sponsor's sole discretion), are required to receive the Hank Parker Outdoor Expedition prize. Failure to show same may result in prize forfeiture.
c. Second Prize: The Long Range head-to-toe outfit will include pants and/or bibs, jacket, hat, gloves, and boots, which will be sent to winner by mail after verification process. Styles and sizes are subject to availability and change.
6. Affidavit of Eligibility and Publicity Release: As a condition to receipt of the prizes, except where prohibited by law, the winners, and guest(s) (as applicable), of such prizes may be required to sign an affidavit of eligibility and release form in favor of Rocky Brands, Inc., the Sponsor. This document may provide, among other things, that the entrant has complied, and will continue to comply, with all of the Sweepstakes rules and that Sponsor and its subsidiaries, affiliates, legal representatives and assigns (the “Company”) has the absolute right and permission to take photographs and video recordings of winners, and to use the resulting photographic or recorded images.
The permission granted under this agreement includes permission to use, re-use, and publish photographic portraits or pictures or recorded video images of winners and winners' likenesses, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, from time to time, in conjunction with winners' own or fictitious names, or reproductions thereof in color or otherwise made through any media for art, advertising, trade, or any other purpose whatsoever, including but not limited to use in advertising and promotional activities, including but not limited to printed, broadcast, internet, or video publications (collectively “Use the Materials” or “Use of the Materials”). Winners understand that the Company will Use the Materials in connection with its business and for other commercial purposes and agree that the Company may Use the Materials in whole, in part, or in composite as it sees fit.
Winners hereby waive all rights to inspect or approve Use of the Material, the photograph or video images themselves, any website or other medium in which they are displayed, and any words, illustrations, or other materials used in conjunction with the photographs or images. Winners also waive all copyrights, rights of publicity, moral rights, and claims based upon those rights, in connection with Use of the Materials by the Company. Winners hereby release, discharge, and agree to hold harmless the Company from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite, whether intentional or otherwise, that may occur or be produced in the taking of said picture or video image or in any subsequent processing thereof, as well as in any publication or Use of the Materials thereof even though it may subject winners to ridicule, scandal, reproach, scorn, and indignity. Winners also hereby waive any claim of trademark infringement or false endorsement for use of winners' name or likeness in connection with Use of the Materials or any image or work derived therefrom.
7. Verification: Winning Sweepstakes participants and entries are subject to eligibility verification. Each participant acknowledges and agrees that the decisions of Sponsor shall be final, binding, and conclusive in all matters relating to the Sweepstakes, including without limitation determinations regarding the eligibility of Sweepstakes participants or entries.
8. Prize Notification: The potential winners will be notified by email, phone, postal mail, and/or express mail at Sponsor's sole discretion. Inability to contact a potential winner or the return of any prize notification as undeliverable will result in the prize being forfeited and an alternate winner will be selected at random from the remaining eligible entries. Where allowable by law, a potential winner will be required to complete an affidavit of eligibility, a liability release, and a publicity release, which must be returned within the time period specified in notification letter or an alternate winner may be selected. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the prize to an alternate potential winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. If winner is eighteen (18) or older, as is required for entry, but not of the age of majority in state of residence, prizes will either be awarded in the name of parent or legal guardian, or parent or legal guardian must ratify and sign any and all documents required of winner.
9. General Restrictions: An unclaimed prize will not be awarded. Sweepstakes entries submitted become the property of Sponsor and will not be returned. Applicable federal, state, and local taxes on prizes are the sole responsibility of winners. No substitutions or cash redemptions permitted, except as provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if advertised prize becomes unavailable. Participants assume all risk of loss, damage, destruction, delay, and misdirection of Sweepstakes entries and are advised to obtain insurance where appropriate. Sponsor is not responsible for incomplete, illegible, misdirected, late, lost, damaged, or stolen submissions of Sweepstakes entries, which may be judged void; for any damage to an entrant's computer system which is caused or occasioned by accessing the Rocky website for purposes of submitting and entry; for lost, interrupted, inaccessible or unavailable networks, servers, satellites, internet service providers, websites, or other connection, availability or accessibility problems arising in connection with or over the course of the Sweepstakes; for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; for any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in Sweepstakes entries, the offering or announcement of any prize or in any prize notification documents; or for any errors of any kind, whether human, mechanical, clerical, electronic, or technical in nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.
10. Disclaimer of Warranties: Sponsor and any parent company, subsidiaries, affiliates, franchisees, advertising cooperatives, advertising/promotion agencies, and all of their respective directors, officers, employees, representatives, and agents make no warranties, and hereby disclaim any and all warranties, express or implied, concerning any prize furnished in connection with the Sweepstakes. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SPONSOR, WITH RESPECT TO ALL PRIZES, DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
11. Release and Conditions of Participation
By accepting prize, winners agree to release the Sponsor, its agents and their respective officers, directors, and employees from liability for any claim arising from or in connection with participation in this Sweepstakes or the use/misuse of any prize/offer awarded, and acknowledge that Sponsor has not made any warranty, representation, or guarantee relative to any prize, including but not limited to its quality or fitness for a particular purpose.
The winner of the Grand Prize acknowledges and understands that certain legal requirements—licensing, insurance, title registration—apply to ownership and operation of a motor vehicle, and that certain dangers are present any time a motor vehicle is used on or off public roadways.
The winner of the First Prize acknowledges and understands that all hunting activity is inherently dangerous and subjects participants in the hunt to risk of life or limb due to dangerous conditions, risks, and hazards including but not limited to poisonous snakes, insects, and spiders, blinds and tree stands, erosion and general conditions of the land, animals both wild and domestic, deep water, persons with firearms both on and off the hunted premises, and the use of vehicles.
The Sweepstakes prize winners expressly assume all such dangers, risks, and hazards and release and agree to protect, indemnify, and hold harmless Sponsor against any and all claims, demands, causes of action, and damages, including attorneys' fees, resulting from any accident, incident, or occurrence arising out of or incidental to participation in this Sweepstakes, the Grand, First, and Second prizes, whether or not any such event or damage is caused by the Sponsor's negligence or gross negligence. Each prize winner agrees that his or her heirs, successors, or assigns will not make any claim or institute any suit or action at law or in equity against Sponsor and each and all of its respective parents, subsidiaries, affiliates, suppliers, divisions, dealerships, advertising and promotional agencies, and all of their respective directors, officers, employees, agents, and assigns. Participants acknowledge that they may be required to execute additional paper release documents and that they may be required, except where prohibited by law, to enter into similar liability waiver agreements with a third party entity related to the Grand Prize or First Prize
12. Force Majeure: Sponsor reserves the right, without prior notice and at any time, to terminate the Sweepstakes, in whole or in part, or modify, suspend, or extend the Sweepstakes in any way, or deem Sweepstakes entry forms void and invalid if it determines, in its sole discretion, that the Sweepstakes is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, glitches or printing or production errors) have destroyed or severely undermined the proper play, integrity, and/or feasibility of the Sweepstakes. In the event Sponsor is prevented from continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or manmade health epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state, provincial or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, extend or terminate the Sweepstakes. Only the type and quantity of prizes described in these Official Rules will be awarded.
13. Entrant's Personal Information: Information collected from entrants is subject to Rocky's Privacy Policy http://www.rockyboots.com/Misc/Privacy.aspx. Rocky Brands will collect all information on the online entry form and will use this to inform the participants of future promotions and contests as well as the results of the current contest.
14. Governing Law: By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, participant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Ohio, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Ohio.
15. Official Rules: These Official Rules will be posted at participating Rocky retail locations, and available online at rockyboots.com/longrange.
16. Winner List: To receive winner names, send a self-addressed, stamped envelope to Long Range Sweepstakes Prize Winners, 39 East Canal Street, Nelsonville, Ohio 45764. All requests must be received by June 1, 2012. Prize Winner information will be available no sooner than December 3, 2011, and will be mailed when the Sweepstakes is officially over and the prizes have been verified and awarded. Limit one request per outer envelope.
